Respecting Copyright & Creative Rights
PattaCloud respects intellectual property rights and expects customers to do the same. This policy explains how copyright infringement reports may be submitted and how PattaCloud may respond to valid notices.
Copyright Respect
PattaCloud supports the lawful use of its infrastructure and does not permit customers to intentionally use PattaCloud services to infringe the copyright or intellectual property rights of others.
What Is Copyright Infringement?
Copyright infringement may occur when protected content is reproduced, distributed, displayed, hosted, or made available without appropriate authorization or a valid legal basis.
Submitting a DMCA Notice
A copyright owner or authorized representative who believes that content hosted through PattaCloud infrastructure infringes their copyright may submit a copyright complaint for review.
- Identification of the copyrighted work
- Identification of the allegedly infringing material
- The location of the relevant content
- Contact information for the reporting party
- A statement of good-faith belief
- A statement confirming the accuracy of the notice
Good-Faith Requirement
Copyright complaints should be submitted in good faith and should contain sufficient information for PattaCloud to understand the nature and location of the alleged infringement.
Review of Complaints
PattaCloud may review copyright complaints to determine whether the report contains sufficient information and whether further action may be appropriate.
- Reviewing the reported material
- Identifying the affected service
- Requesting additional information
- Contacting the relevant customer when appropriate
- Taking reasonable action based on the circumstances
Possible Enforcement
Where a complaint is sufficiently supported, PattaCloud may take reasonable action consistent with applicable law and its service policies.
- Requesting removal or restriction of content
- Requesting corrective action
- Temporarily restricting affected services
- Suspending services in appropriate circumstances
- Terminating services for serious or repeated violations
Customer Responsibility
Customers are responsible for content hosted, stored, distributed, or made available through their VPS. Customers should maintain appropriate records of permissions, licenses, and rights where applicable.
Counter-Notification
Customers who believe that content was incorrectly identified or restricted may submit a response explaining why the reported material should remain available.
Repeat Infringement
PattaCloud may take stronger action against accounts or services associated with repeated or serious copyright infringement.
- Additional warnings or corrective requests
- Content or service restrictions
- Temporary suspension
- Termination where appropriate
Abusive Copyright Reports
Copyright reporting mechanisms must not be used to intentionally harass customers, submit fraudulent claims, or attempt to remove lawful content through deceptive means.
Applicable Law & Review
PattaCloud may evaluate copyright complaints based on applicable law, the information provided in the notice, the nature of the reported material, and the circumstances surrounding the complaint.
